These Terms & Conditions govern your booking and participation in tours and experiences operated by Peak Tours ("Peak Tours", "we", "us" or "the Operator"). By making a booking with us, you agree to these terms on behalf of yourself and everyone in your party. Please read them carefully.
A booking is confirmed once payment has been received and we have issued a confirmation email. It is your responsibility to provide accurate contact details and to read your confirmation, which includes your pickup or meeting point, time, and any tour-specific information. Please check your confirmation on arrival in your inbox and contact us promptly if anything is incorrect.
Our tours involve activities in outdoor and public environments, including travel by road, ferry and cruise vessel, walking on natural and uneven terrain, steps, headlands, beaches and lookouts. While we take reasonable care for your safety, some risks are inherent and cannot be entirely eliminated. By participating, you voluntarily accept these risks and, to the extent permitted by law, release Peak Tours, its staff, guides, agents and contractors from liability for injury, loss, damage or claims arising from:
By participating, you confirm that:
Nothing in these terms excludes, restricts or modifies any rights or remedies you may have under the Australian Consumer Law or other applicable law that cannot lawfully be excluded.
Our tours operate rain or shine, and we recommend bringing weather-appropriate clothing. In rare cases of severe weather, natural events, road or attraction closures, or other circumstances beyond our reasonable control, we may cancel, shorten or reschedule a tour. Where we cancel for these reasons, you will be offered a reschedule or a full refund. We are not liable for incidental costs (such as travel or accommodation) arising from such changes.
Some tours include third-party services such as ferries and cruise vessels. These operate to their own schedules and conditions, which are outside our control. Where a third-party service is delayed, altered or cancelled, we will do our best to adjust the itinerary, but cannot guarantee that every listed inclusion will run exactly as described on a given day.
Tours depart promptly at the scheduled time. Please arrive a few minutes early. Guests who arrive late or do not show up are not eligible for a refund or reschedule.
You are responsible for assessing whether a tour suits your fitness and health, and for disclosing relevant conditions when booking. We may decline participation, or end a guest's participation without refund, where conduct is unsafe, unlawful, or unreasonably disruptive to other guests or staff, or where a guest is affected by alcohol or drugs to a degree that compromises safety.
Children are welcome on tours as indicated, at the child rate shown. Minors must be accompanied by a responsible adult who accepts these terms on their behalf and supervises them throughout.
All prices are quoted in Australian Dollars (AUD) and include applicable taxes unless stated otherwise. Prices and inclusions are subject to change, but the price confirmed at the time of your booking is the price you pay. Payment is processed by our third-party booking and payment provider; we do not store your card details.
We offer private, corporate and custom group tours, generally for groups of up to around 30 guests, with larger groups considered case by case. Custom bookings may be subject to additional terms communicated at the time of quoting.
Your use of this website is subject to our Privacy Policy, which forms part of these Terms & Conditions. We may update or amend these terms at any time by posting the revised version on this website; the version in effect at the time of your booking applies to that booking.
